“Zero Draft of the Proposed Hazardous Wastes & Recyclable Materials Rules, 2008”

Consultation Workshops on “Zero Draft of the Proposed Hazardous Wastes & Recyclable Materials (Management & Handling) Rules, 2008”

Dear Sirs,

As you are aware, the Ministry of Environment & Forests had issued a draft gazette notification on Hazardous Materials (Management, Handling and Transboundary Movement) Rules, 2007 on September 28, 2007. This notification was to supersede the Hazardous Waste (Management & Handling) Rules, 1989 along with all its subsequent amendments.

It seems, MoEF had received a large number of representations not only from Industry but also from State Pollution Control Boards and other stakeholders, specially highlighting impracticality and non-implementability of the proposed 2007, Notification.

During the numerous awareness workshops that CII had organized, participants had strongly expressed the following:

Ø Why the existing regime of managing hazardous waste with which industry, SPCBs and other stakeholders have now become so familiar had to be re-engineered altogether ?

Ø Why good points of existing 1989 HW Rules not retained ?

Ø How all of a sudden, hazardous materials in addition to hazardous waste also are sought to be regulated ? What is the rationale?

Keeping in view the concerns of industry, SPCBs and other stakeholders, CII has attempted to redraft the 2007 Notification by amalgamating the good features of HW Rules 1989 as amended till 2003 and the good points of 2007 notification. Without of course, compromising on the twin objectives of firstly managing hazardous waste in the environmentally sound and safe manner in the country and secondly to promote recovery, recycling and re-use of useful resources from hazardous waste and recyclable materials. In addition, it was also kept in mind that transboundary movement of hazardous waste should not adversely impact the integrity of our own environment.

The zero-draft of proposed notification as prepared by CII is now ready. The purpose of the forthcoming series of consultation workshops is to present this zero draft to all the stakeholders, seek their approval and inputs, so that proposed draft could be finalized for presentation to MoEF for its kind consideration and further necessary action. The workshops are scheduled to be held as follows:

15 March, 2008 – Delhi ; 18 March, 2008 – Bangalore; 20 March, 2008 – Mumbai

BACKGROUND :

Ministry of Environment and Forests, having issued the draft Gazette Notification on Hazardous Materials (Management, Handling and Transboundary Movement) Rules, 2007, received a number of representations, making the task of issuing the final notification rather difficult. If the final notification is not issued, the improvements that were made over Hazardous Waste Rules 1989 will also not see the light of the day at least till September 28, 2008, the time by when draft notification of September 28, 2007 will automatically lapse.

In order, not to lose time as well as to harness the desirability of good features of both Draft Hazardous Materials Rules, 2007 and that of Hazardous Waste Rules, 1989, Confederation of Indian Indusrty with the help of Dr. Lakshmi Raghupathy, Former Director, MoEF has put together a Zero Draft of the proposed “Hazardous Waste & Recyclable Materials (Management and Handling) Rules, 2008 for consultation and discussions with all the stakeholders.

Background note

What is “Biotechnology”.

“Biotechnology” has been described as “utilization of living organisms for the benefit of mankind”. While this technology has been used/applied in various forms since times immemorial for foods i.e. preparation of wine, bread, curds etc. Only in the past 10-15 years with availability of high performance instruments it has gained prominence with it’s utilization in healthcare, drugs formulations diseases resistant crops. So much to that cloning of animals, through stem cell research is being made possible. Such high speed development of research technology also has raised alarm bells on the future course of mankind and food production. Regardless it is now well accepted that this is one tool which can provide additional food for billions of human beings on the same land mass (planet Earth), as well as make human more healthy and productive. In order to realize the full potential of Biotechnology as a front line area of research and development with an overwhelming impact on the society, our enterprises should be nurtured to give Bio-products of different specialized and niche areas as per individual enterprises as well as attuned to biodiversity.

Brief of the Seminar.

The Goa State Industries Association(GSIA) is organising its 2nd Seminar on “BioGoa 2008 – Entrepreneurship & Technologies in Biotechnology” on 1st March, 2008 at Hotel Fidalgo , Panaji in association with Dhempe College of Arts & Science.

Shri Dayanand Narvekar, Hon’ble Minister for Finance & IT, Govt. of Goa has consented to be Chief Guest. Mr. Srinivas Dempo, Chairman & Managing Director – Dempo Group of Companies will be the Guest of Honour and Dr. Purnima Sharma, Biotech Consortium India Ltd., New Delhi will be the Keynote Speaker for the Inaugural function.

The main aim of the seminar is to “Create Entrepreneurs in Biotechnology Sector”. With industries hardly coming to Goa, GSIA has taken the onus on itself to create awareness & facilitate in creating entrepreneurs.

Speakers from across the country namely Dr. Bosco Henriques, Dr. Siddhivinayak Barve & Dr. K.M. Shankar are invited to enlighten the delegates on various topics like ‘Natural dyeing of textiles’, ‘Biotechnology of Medicinal & Aromatic Plants’, ‘Marine Diagnostics’ etc. A special session on ‘What Entrepreneurs need to know’ from the point of view of Financial aspects & Risk Awareness would also be held by Mr. Sandeep Bhandare and Dr. P.D. Promotion of ventures for Biofertilizers, Biopesticides, Tissue-culture, Tropical Floriculture and Horticulture to be considered. Cultivation of Auyurvedic Medicinal and Herbal Plants along with Mushroom and Food Biotech Ventures to help mass scale Rural Employment.

With the aim of the seminar in long term to “Create Entrepreneurs”, the audience will be exposed to the ‘reality-check’ mechanism when speakers will let know the risks involved, their management as well as views of finance experts in approaching their prospective projects.

The details of the trade fair like product profile, reimbursement of expenses etc. are self explanatory. However, the ITPO has informed that the space rental charges will be Rs.4,500/- in place of Rs.7,800/- and the last date to accept the nomination is extended up to 28th February’ 2008.

Corporate Social Responsibility enjoins corporate philanthropy and if built into the strategic intent of the company is bound to enhance both organizational and stakeholder value. CSR is about how businesses align their values and behaviour with the expectations and needs of stakeholders – not just customers and investors, but also employees, suppliers, communities, regulators, special interest groups and SOCIETY as a whole. CSR describes a company’s commitment to be accountable to its stakeholders.

Reschedule of Timing of Pay Offices at Bicholim, Mapusa, Karaswada.Letter received from Shri M. Dorai, Assistant Director, ESIC, Panaji Regional Office.

It has been decided to reschedule the timing of pay office at Bicholim, Mapusa and Karaswada as follows:
1. Pay Office Bicholim: Every Wednesday between 12.30 to 1.30 p.m.
2. Pay Office Mapusa: Every Wednesday between 12.30 to 1.00 p.m.
3. Pay Office Karaswada: Every Wednesday between 1.00 to 2.00 p.m.
This has been done following demand of a few employers to change the timing of pay office during lunch hour to enable their employees to avail cash benefit during lunch hour without effecting their work.

The new timing will be effective from 30/1/2008.

Enterprises may kindly take note of the same.

Sub: Census of covered/ coverable factories/establishments under the ESIC scheme.

Employees’ State Insurance Corporation has engaged the services of M/s. Sai Life Care, Kothambi Pali Goa which is an NGO for conducting census of factories & establishments, including educational institutions, private hospitals & nursing homes in the State of Goa in talukas where the ESI Scheme is implemented. The census is for the purpose of having statistical information and database regarding factories/ establishments covered/ coverable under the ESI Act in the implemented areas and to get feedback from the employers regarding the services being provided by us in our endeavour to improve our services. The census will be carried out during the months of February & March 2008.

Members are request to co-operate with the census enumerators and provide them with the information requested by them.

Your co-operation in the matter will be highly appreciated.
