Sir,

Please refer this office letter of even number dated 18 October, 2007 on the subject mentioned above. ITPO has informed that they are charging Rs. 12,000/- plus service tax (12.36%) for the constructed booth of 09 sq.mtr. each.

ITPO has also intimated that Ministry of Commerce of People’s Republic of China (MOFCOM) which is the organizer for this fair will be making available more than 100 constructed booths of 09 sq.mtrs. each to ITPO on complimentary basis. A brief about the fair is enclosed (Annexure) as a ready reference which enumerates the various facilities and other inputs which will be provided by MOFCOM to us for the benefits of the participants including wide publicity and one to one meeting with concerned trade and industry. The fair will be general in nature, however, certain specific product profile which has been indicated includes short fiber cotton and cotton yarn, coir, jute fiber & products, sandalwood products, antibiotics and bulk drugs, castor oil, manganese ore, fine lead ore, bauxite ore, granite & fine copper etc.

The “South Asian Countries Commodity Fair” is planned to have around 300 booths and covers 5500 square meters. In order to show the sincerity of Chinese Government to expand import from South Asian countries (including India) and reduce trade deficit, Office of DC (MSME), Coir Board & KVIC are participating under MSME India stall in the said fair.

With a view to increase participation of women representatives of participating units, the provision of SSI-MDA Scheme has been modified in 2006. The major changes in the earlier scheme are as under:

(i) the Govt. of India will reimburse the 75 percent of air fare by economy class subject to upper limit of Rs.40,000/- (Rs.60,000/- for Latin American Countries) for small manufacturing enterprises and 90% (with corresponding absolute ceiling) for Micro manufacturing enterprises.
60 percent subsidy on space rent.

Subsidy of Rs. 15,000/- per participating unit for the shipping cost of exhibits.

The total subsidy on air fare, shipping cost and space rent will be restricted to Rs.1.25 lakhs per unit (Small manufacturing enterprises) and Rs.1.50 lakhs for Micro manufacturing enterprises or actual, whichever is less.

Any unit can avail of this facility only once a year and Only one person of the participating unit would be eligible for subsidy on airfare.

2. ITPO is charging only Rs. 12,000/- + 12.36% service tax for constructed booth of 09 sq.meter. The participating units will also carry/manage their exhibits (to and fro) including customs clearance etc.
3. Since considerable importance is being attached to the participation of office of DC (MSME) in the above fair, you are requested to identify SMEs entrepreneurs and assist/ motivate and select them to participate in this fair.

4. You are, therefore, advised to select small & micro manufacturing enterprises and collect Rs, 5,393/- inclusive service tax only as 40% of space rental charges from the participating SMEs on or before last date i.e. 14 November, 2007 strictly as it will not be possible for this office to book space if the proposal is not received by 14 November, 2007. The amount of Rs. 5,393/- only for 9 sq. mts shall be sent by a DD favouring PAO (SSI), New Delhi along with detailed list of participating units.

5. A Copy of the proforma for passport particulars is enclosed for representatives who are likely to visit the fair. The filled up proforma may be forwarded to this office (in triplicate) as early as possible along with copy of first & last two pages of their valid passport.

6. It is also requested that the participating units may please be advised to send the passport particulars of their two representatives along with first & last two pages of their valid passport for recommendation of Visa etc. to ensure at least one representative may visit the fair due to unforeseen circumstances.

7. The representatives of the selected units will be reimbursed of the air fare as applicable after participation in Fair/ Exhibition on the basis of submission of claim.

8. The space is available on first cum first served basis.

CII-MoEF Workshop on Hazardous Materials (Management, Handlling & Transboundary Movement) Rules 2007

The Ministry of Environment & Forests (MoEF), Government of India has recently (28 September, 2007) brought out the Draft on Hazardous Materials (Management, Handling and Transboundary Movement) Rules, 2007 in supersession of the existing Hazardous Wastes (Management and Handling) Rules 1989. We have 60 days to submit suggestions/objections on the proposed Draft Rules.

To understand its implication, and to discuss issues of concerns and possible solutions, the CII Goa State Office and the Ministry of Environment & Forest (MoEF) intends to conduct a workshop on Hazardous Materials (Management, Handling & Transboundary Movement) Rules 2007.

“Package for Promotion of Micro and Small Enterprises” status.

The booklet detailing the elements of the “Package for Promotion of Micro and Small Enterprises” announced in Parliament in Feb/March 2007 was circulated to all concerned vide circular letter of even number dated 26.3.07 of the Office of the Development Commissioner, Ministry of Micro, Small and Medium Enterprises, New Delhi.

Consequently there are querries from different stakeholders to know the implementation status of the said Package. The Package, along with all relevant information about the policies/ programmes/ schemes in operation and implementation status of the package is available the web-site: http://www.dcmsme.gov.in/ for information and ready reference. NO ESI LIABILITY ON OUTSIDE JOBS


NO ESI LIABILITY ON OUTSIDE JOBS ===========================

The principal employer is not laible to pay ESI on outside jobs executed through contract labour. This clarification has come from the highest court of the land, the Hon’ble Supreme Court.

In the case of ESIC Bangalore versus JMD Fashions (No. MFA 1089/2001), the Karnataka High Court held that outside establishments are not immediate employers under Section 2(13) of the ESI Act. The ESIC decided to go on appeal against this verdict, before the Supreme Court. The SC in its judgment dated 12.03.2007 dismissed the petition of the ESIC and upheld the decision of the HC.

Recently the MP High Court had also given a similar judgment, stating that in case of job works done by contract labour, there is no element of supervision by the principal employer, and therefore the principal employer will not be responsible for payment of ESI contributions in respect of such contract labour.

Earlier, the ESI authorities had been demanding and in many cases, even recovered the ESI contributions from the employers for outside jobs done by contracted vendors.

ESI contribution on outside job works
Recent judgments in this regard provide relief to employers who outsource work to outside establishments.

As per guidelines prescribed in circulars dated 26.08.2005 and 17.08.2006 by ESI Corporation, New Delhi, the Corporation’s inspectors made huge demands of ESI contributions on the employers at the time of periodical inspection, causing undue hardship to the employers.

As mentioned above, the Supreme Court has upheld a verdict of the Karnataka High Court in the ESIC v/s JMD Fashions – MFA 1089/2001 case, that outside establishments are not immediate employers under Section 2(13) of the ESI Act, and so, if jobs are done outside by contract labour, and where there is no element of supervision by the principal employers on such contract labour, the principal labour will not be liable for ESI contribution on job work charges paid to such contract labour.

In a similar case, the Madhya Pradesh High Court has also upheld this view, and has further held that checking of works executed by such outside contractors is a normal activity, for the purpose of finally accepting or rejecting the work done, on the touchstone of job specifications, which cannot be termed as supervision or control.

These decisions have finally set to rest the controversy caused by the decision of a Bench of the Madras High Court in the case of Khaleel Corporation v/s ESIC.

In the light of this, all Associations and Industry Chambers should urge the ESIC, New Delhi to withdraw its circulars dated 26.08.2005 and 17.08.2006.

ESI Contribution on Casual Contractors
The Bombay High Court, relying on Supreme Court judgments, has held that casual contractors like plumbers, electricians, air conditioner repairers, computer repairers, TV repairers, etc who are engaged for temporary repair work will not be coverable under the ESI Act (ESIC vs RK Furniture & Another – 2007 LLR 14).

This should come as a great relief to employers who have for a number of years faced the ordeal of meeting demands for contributions on casual contract works, after every ESI inspection. Apart from the monetary aspect, it was a time consuming and expensive task to cull out from accounting records, payments made for such sporadic engagement of technicians and contractors, and pay ESI contributions.

All Associations and Industry Chambers should urge the ESIC, New Delhi to issue appropriate instructions to its ROs and Inspection staff and reverse the practice of demanding contributions on such casual, stray contracts. Otherwise, the employers will be left with no remedy other than to approach the appellate forum for redressal, every time.
