You will be glad to know that Goa Management Association (GMA), Porvorim, Goa has organized a Talk on the topic “Entrepreneurship – the need for Goa” by Mr Walter Vieira. He has long and varied experience of more than 32 years in the practice of management consultancy and presently based in Mumbai. He is the Founder President of Marketing Advisory Services Group ( MAS Group), Mumbai since 1975.

ABOUT THE SPEAKER

Walter Vieira has been described by Philip Kotler (the world’s guru on ‘Marketing’) as one of ‘the best speakers on Marketing in Asia, and perhaps world wide.’

Walter is a Certified Management Consultant and a Fellow of the Institute of Management Consultants of India. He has been in the practice of management consultancy since 1975 (32 years) when he set up the first marketing consultancy company in India. He was awarded the Life time Achievement Award in 2005.

He earlier worked in senior positions in Glaxo, Warner Lambert & Boots for 14 years, when he left as Marketing head for India – and concurrently General Manager for Boots, Sri Lanka and Bangla Desh. He was responsible for some of the most successful launches in the pharmaceutical industry.

Walter has been consultant in marketing and training to many of the largest corporations in India – A V Birla Group (textiles, cement, aluminium); Tatas (IT, cosmetics, consumer, chemicals; Mafatlal (textiles); Levers; BASF; Bayer; Hoechst; Philips et al and organizations in USA, Middle East; Africa, South East Asia. He has covered a broad canvas from Industrial products to FMCG.

Walter is the only speaker to be invited to address three consecutive World Congress of Management Consultants in Rome, Yokohama and Berlin.

Walter has the distinction of writing the longest running column ‘Executive Career Path’ for Business World (India). He has published over 700 articles in the Business & General Press. He has written 11 books – some of them best sellers – translated into Chinese and Indonesian and 3 books in collaboration with Prof. C. Northcote Parkinson of Parkinson’s Law fame.

He has been active in social marketing – and has been ‘probono’ consultant to Cancer Aid Society; World Wildlife Fund for Nature; Consumer Education & Research Centre; The Workshop for Mentally Challenged Women – among others.

He has been the President of the Institute of Management Consultants of India (1986-1991); the Founder/Chairman of Asia Pacific Conference of Management Consultants; and the first Asian to be elected Chairman of the 42-country world apex body of management consultants (ICMCI) International Council of Management Consulting Institutes. He is a special invited Director on the Board of the Institute of Management Consultants of Thailand.

Walter has been Visiting Professor since 1989 at the Kellogg Business School, N W University, USA; and has lectured at Cornell; Drexel; Brady; NYU; URI; Lake Forest – in USA; Boston College, Zaragoza, Spain and many other business schools in Asia.

Subject: Self-sealing of exports goods -reg
Attention of the Trade is invited to the Board’s Circular No. 860/18/2007-CX ,dated 22.11.2007 issued from F.No. 209/06/2007-CX-6 on the above subject.

2. Attention is also invited to the Board’s Circular No. 736/52/2003-CX dated 11.08.2003 issued from F.No. 201/1/2003-CX.6 and this Office Trade Notice No. 31/2003-CE dated 22.09.2003 on the above subject. Vide this Circular, the facility of self-sealing was extended to all categories of Manufacturer-Exporters. In this regard, references have been received from field formations that in spite of this facility being available to the exporters, a large “number of exporters prefer stuffing and sealing of export containers in the presence of Central Excise Officers. However, with increase in number of such exports and requests for stuffing and sealing in the presence of Central Excise Officers, the workload of the Central Excise Range staff is increasing substantially. As a consequence, it is felt that their normal Central Excise Range work is being adversely affected. This necessitated re-examination of the procedure relating to stuffing and sealing of export containers in the presence of Central Excise Officers.
3. The matter has been examined by the Board. It is seen that even those manufacturer-exporters who have the option of self-sealing make request for Central Excise sealing since the percentage of examination at the port of export of such containers is substantially reduced as per the prescribed guidelines. However, it may be noted that as per para 2.1 B of Board’s Circular No. 6/2002-Cus dated 23.01.2002, where exports are against free Shipping Bills, no opening/examination of containers is to be done at the port of export, except where there is intelligence/information about any concealment, mis-declaration, etc. The examination norms in respect of free Shipping Bills does not distinguish between a containers, which have come under self sealing by the Manufacturer/Exporter or which have been stuffed/ sealed by
jurisdictional Central Excise officers.

4. In view of the above, it has been decided that henceforth in case of exports under free Shipping Bill, i.e. Shipping Bills wherein no export benefits are being sought, the Manufacturer-Exporter shall mandatorily resort to self-sealing of containers. The Central Excise Officers shall not attend to the request of stuffing and sealing of export containers in their presence, in case the exports are under free Shipping Bills. Further, with a view to ensure safety and security of the export consignment, all such containers should be sealed with tamper proof one time bottle seals as stipulated vide Board’s Circular No. 01j2006-Cus. dated 02.01.2006.

5 Accordingly, Board’s Circular No. 736j52j2003-CX dated 11.08.2003 and this Office Trade Notice No. 31j2003-CE dated 22.09.2003 stand modified to the above extent.

6. All the Trade Associations and Chamber of Commerce and Industries are requested to bring the contents of this Trade Notice to the notice of their member manufacturers and trade in general.

Confederation of Indian Industry-Institute of Quality (CII-IQ) in association with the Department of Consumer Affairs, Government of India and The Deutsche Gesellschaft für Technische Zusammenarbeit (GTZ), GmbH Germany is organizing a seminar on The revision of Standards of Weights and Measures Enforcement Rules on 1 February 2008 at Chennai.

Objectives:

· To create awareness on the significance and intricacies of the Weights and measures Enforcement Rules.
· Identify obsolete provisions which are impediment to the growth of trade and industry in the country.
· Preparation of a model Enforcement rules in line with best international practices for uniform adoption across the country
· Empower consumers to protect themselves in the field of legal metrology

Background:
Metrology is the science of measurements. That part of metrology where measurements are under Government regulation for providing protection to consumers and stake holders, is called Legal Metrology. The instruments are regulated to ensure that the measurement results provided by such instruments are accurate and true and transactions carried out on such instruments are fair & acceptable to all stakeholders. The Standards of Weights and Measures Act, 1976 and Standards of Weights and Measures (Enforcement) Act, 1985 provide enabling provisions for the regulation of such measuring instruments. For regulation purposes, the Acts provide for issue of licence for manufacture, sale, and repair of weighing and measuring instruments, provides for their verification and collection of fee. The details of the regulatory requirements are prescribed in the form of a Rule called the Standards of Weights and Measures [Enforcement] Rules. The compliance to the requirement of the Enforcement rules is mandatory and non compliance results in prosecution/ cancellation of licences, etc.

The Rule making power at present rests with the States. To ensure uniformity in implementation, Model Enforcement Rules were prepared and sent to the States for adoption. During adoption by States, variations in different provisions of the rules have crept in. This non uniformity has become an impediment to the progress of development in the country. Variations in the interpretation of the rules have also lead to difficulties in carrying out the trade uniformly across the country. Accordingly a draft enforcement rules were prepared and circulated to States by the Department of Consumer Affairs some time back. It is proposed to discuss this draft rules with different Stakeholders across the country to evolve a simple but effective rule for regulation in the interest of all. Simultaneously, the Department of Consumer Affairs have entered into an Agreement with the Government of Germany for “Strengthening Consumer Protection in India”. Since implementation of a proper legal metrology system contributes greatly to a better consumer protection, making the system effective and efficient has been taken up as a project activity under the Agreement. GTZ is the organization implementing the project under the Agreement in India with the support of other organizations like CII.

To achieve the best result, it is proposed to form 3-4 working groups during this seminar, each with separate topics [of the rules], for discussion and recommendations in crucial areas of regulation, like; procedure and requirement for the issue of licence for manufacture, selling, repairers of weighing and measuring instruments and their regulation. The seminar would provide opportunity to discuss the revision of Standards of Weights and Measures Enforcement Rules.
