Doubts have been raised regarding the Service Tax on freight charges in certain cases. Postal Department has engaged Shipping Companies for conveyance of outward surface Indian Postal Mails to various Ports of foreign countries and handling of export cargo, passenger baggage, etc. It is clarified that such a service provided by Shipping Company would be in the nature of ‘distribution, management and logistics’ service and delivery order charges and inland haulage charges collected by Shipping Companies would be considered as being for such distribution, management and logistics service. Such a service is specifically covered under category ‘business support services’ and is liable to Service Tax.

Dear Sirs,

As you are aware, the Ministry of Environment & Forests had issued a draft gazette notification on Hazardous Materials (Management, Handling and Transboundary Movement) Rules, 2007 on September 28, 2007. This notification was to supersede the Hazardous Waste (Management & Handling) Rules, 1989 along with all its subsequent amendments.

It seems, MoEF had received a large number of representations not only from Industry but also from State Pollution Control Boards and other stakeholders, specially highlighting impracticality and non-implementability of the proposed 2007, Notification.

During the numerous awareness workshops that CII had organized, participants had strongly expressed the following: –

Why the existing regime of managing hazardous waste with which industry, SPCBs and other stakeholders have now become so familiar had to be re-engineered altogether ?

Why good points of existing 1989 HW Rules not retained ?

How all of a sudden, hazardous materials in addition to hazardous waste also are sought to be regulated ? What is the rationale?

Keeping in view the concerns of industry, SPCBs and other stakeholders, CII has attempted to redraft the 2007 Notification by amalgamating the good features of HW Rules 1989 as amended till 2003 and the good points of 2007 notification. Without of course, compromising on the twin objectives of firstly managing hazardous waste in the environmentally sound and safe manner in the country and secondly to promote recovery, recycling and re-use of useful resources from hazardous waste and recyclable materials. In addition, it was also kept in mind that transboundary movement of hazardous waste should not adversely impact the integrity of our own environment.

The zero-draft of proposed notification as prepared by CII is now ready. The purpose of the forthcoming series of consultation workshops is to present this zero draft to all the stakeholders, seek their approval and inputs, so that proposed draft could be finalized for presentation to MoEF for its kind consideration and further necessary action.

The details of these Consultation Workshops are enclosed for your kind & ready reference. We expect very large participation. Registration of participants therefore shall be strictly on first – come – first – served basis, keeping in view the seating capacity of halls at different venues.

BACKGROUND :

Ministry of Environment and Forests, having issued the draft Gazette Notification on Hazardous Materials (Management, Handling and Transboundary Movement) Rules, 2007, received a number of representations, making the task of issuing the final notification rather difficult. If the final notification is not issued, the improvements that were made over Hazardous Waste Rules 1989 will also not see the light of the day at least till September 28, 2008, the time by when draft notification of September 28, 2007 will automatically lapse.

In order, not to lose time as well as to harness the desirability of good features of both Draft Hazardous Materials Rules, 2007 and that of Hazardous Waste Rules, 1989, Confederation of Indian Indusrty with the help of Dr. Lakshmi Raghupathy, Former Director, MoEF has put together a Zero Draft of the proposed “Hazardous Waste & Recyclable Materials (Management and Handling) Rules, 2008 for consultation and discussions with all the stakeholders.

If the final notification is not issued, the improvements that were made over Hazardous Waste Rules 1989 will also not see the light of the day at least till September 28, 2008, the time by when draft notification of September 28, 2007 will automatically lapse.

In order, not to lose time as well as to harness the desirability of good features of both Draft Hazardous Materials Rules, 2007 and that of Hazardous Waste Rules, 1989, Confederation of Indian Indusrty with the help of Dr. Lakshmi Raghupathy, Former Director, MoEF has put together a Zero Draft of the proposed “Hazardous Waste & Recyclable Materials (Management and Handling) Rules, 2008 for consultation and discussions with all the stakeholders.

RESOURCE PERSONS :

These workshops will be conducted by Dr. Lakshmi Raghupathy, Former Director, MoEF and Mr. K. P. Nyati, Confederation of Indian Industry. All the State Pollution Control Boards are being invited to participate in these workshops. The Bangalore workshop is in collaboration with the Karnataka State Pollution Control Board.

REGISTRATION FEE :
With a view to have serious participation, a lump sum of Rs. 3500 (Rs. Three Thousand Five Hundred only) per participant will be charged as the registration fee. The Fee will include course material, lunch, tea/coffee and snacks. There will be a 10% rebate in the registration fee for three or more participants from the same organization. The payment could be made through Cheque/ DD drawn in favour of “Confederation of Indian Industry” payable at New Delhi.

Participation of Office of DC in Internation Trade Fairs.

Office of D.C. MSME is participating in Cairo International Fair, Egypt (March 15 – March 25 2008) and INDEE- St. Petersburg -2008 (Indian Engineering Exhibition) (March 11- March 14 2008) at St. Petersburg, Russia.
Dear Members,

1: Letter No.5 (13)/ 2006 – MA dated 03.12.07 from the O/o D.C. MSME regarding participation of O/o D.C. MSME in Cairo International Fair from March 15 – March 25, 2008.

The details of the trade fair like product profile, reimbursement of expenses etc. are self explanatory. However, the ITPO has informed that the space rental charges will be Rs.4,500/- in place of Rs.7,800/- and the last date to accept the nomination is extended up to 28th February’ 2008.

2: Letter No.5 (12) /2007-MA dated 3.13.07 regarding participation of the O/o The D.C. MSME in INDEE-2008.

The details of the trade fair like product profile, reimbursement of expenses etc. are self explanatory are available at GSIA office. However. the last date to accept the nomination is 20th February, 2008 instead of 10th January 2008.

3: The O/o the D.C. MSME has also decided to:
. Provide rent free space in the exhibition.
. Reimburse 100% economic class air fair for one representative
. Reimburse shipping cost upto Rs.15,000/-. Subject to the overall ceiling of Rs. 1.25 Lakhs.
